Dublin - Circuit Court - County Registrar - Notice re: Civil Motions, Landlord and Tenant, Taxation of Costs applications only

Further to the statement of the President of the Circuit Court and due to the current provisions of the Health Act 1947 (Section 31A -Temporary Restrictions) (Covid-19) Regulations 2020, and in anticipation of the easing of Level 5 Covid -19 restrictions, the Civil Motions, Landlord and Tenant and Taxation of Costs hearings listed before the County Registrar will resume hearing from Tuesday 11 May 2021, in Court 33, Ground Floor, Aras Ui Dhalaigh, Inns Quay, Dublin 7 (Court capacity 9 persons) in a hybrid list on a trial basis.

Motions where one of the parties is a litigant in person, will be heard in Court 33 in a staggered list commencing at 10 am. The parties must attend Court for the hearing and the motion times will be published on the legal diary.

Thereafter, all other civil motions will be heard by VMR, details of which will be provided to the Law Society and Bar Council in the usual manner.

Arrangements are in place to ensure compliance with HSE distancing requirements and your cooperation is appreciated and expected. To comply with social distancing requirements staggered times have been allocated for practitioners to attend Court for the hearing of these motions. You must only attend Court at your scheduled time. The hearing will take place in accordance with public health and the Courts Service guidelines.

Landlord and Tenant motions will be listed for hearing as already assigned.

Taxation of Costs will be listed and heard as already assigned.

PLEASE NOTE THE FOLLOWING

  1. Attend in court at the appointed/designated time as there are no waiting facilities.
  2. There will not be a second call due to the current restrictions.
  3. The parties must leave court and remove all items at the expiry of the allotted time.
  4. The minimum number of necessary legal representatives for each party to attend court. The attendee must be able to deal with the matter.
  5. All affidavits and exhibits musts be filed in the Dublin Civil Office NOT LATER THAN 5 WORKING DAYS prior to the hearing. Documents will not be accepted in Court. When filing documents for upcoming court attendance ensure the Court Office is notified of the correct record number, date and time of hearing of the matter.
  6. In motions to which Order 26 applies, the Affidavit and Certificate required by Rule 2 and the timer period specified in Rule 4 apply and must be filed and the provisions of point 5 apply.
  7. The moving party must lodge in the Circuit Court Office, NOT LATER THAN 5 WORKING DAYS prior to the hearing date, a hard copy, clean, complete, indexed and paginated book of pleadings and proceedings for the hearing of the application.
  8. Where the Respondent to the Motion is a litigant in person the moving party must inform the litigant in person of the hearing date and time.

Arrangements will be made in due course of the re-listing of those matters adjourned because of the Covid 19 pandemic restrictions. As always application can be made to the Circuit Court Office for the listing of any urgent matter.
